This Terms and Conditions of Shipping Services document ("TNC") governs the contractual relationship between Rayspeed Asia ("Service Provider") and the Sender in connection with shipping services for goods and documents. By using the Service Provider’s services, the Sender is deemed to have read, understood, and agreed to all terms contained in this TNC.

Article 1: Definitions

  1. Service Provider refers to Rayspeed Asia, which provides shipping services for goods and documents.
  2. Sender refers to the party who submits goods or documents to the Service Provider for shipment.
  3. Recipient refers to the party designated to receive the shipped goods or documents.
  4. Shipment refers to goods or documents submitted to the Service Provider for delivery.
  5. Tracking Number refers to the unique number provided by the Service Provider for each Shipment as identification and tracking.
  6. Customs refers to the government authority responsible for supervising and collecting duties or taxes on goods entering or leaving a country.
  7. Force Majeure refers to extraordinary circumstances beyond reasonable control, including but not limited to natural disasters, war, riots, government actions, carrier regulations, or other unforeseen disruptions.

Article 2: Scope of Services

  1. The Service Provider provides shipping services for goods and documents from the Sender’s location to the designated Recipient’s location.
  2. Services include pickup, customs processing, transportation, and delivery.
  3. The Service Provider reserves the right to refuse any Shipment deemed unlawful, dangerous, unsafe, or non-compliant with regulations in the origin or destination country, or carrier policies.
  4. The Service Provider reserves the right to open and inspect Shipments without prior notice for security, legal, or regulatory purposes.
  5. If a Shipment is rejected, cannot be accepted, or cannot be returned due to regulations of the origin country, destination country, or carrier, it may be destroyed without liability.

Article 3: Sender Obligations

  1. The Sender agrees and is responsible for providing complete and accurate information regarding the Shipment, including but not limited to sender and recipient names, addresses, identification, and contact details.
  2. The Sender is fully responsible for proper packaging of the Shipment.
  3. The Sender must ensure the Shipment is securely packaged in accordance with the nature of the goods and shipping standards.
  4. If the Sender uses paid packaging services provided by the Service Provider, responsibility for packaging quality transfers to the Service Provider in accordance with its service standards. Responsibility for contents and information remains with the Sender.
  5. The Sender warrants that the contents of the Shipment do not violate applicable laws or regulations in the origin, transit, or destination countries, or carrier policies.
  6. The Sender is responsible for all shipping costs, import duties, taxes, handling fees, and other charges arising from the Shipment if the Recipient refuses payment, unless otherwise agreed.
  7. The Sender warrants that they are the lawful owner or have full rights to submit the Shipment and that it is free from any liens or third-party claims.
  8. The Sender releases the Service Provider from any legal claims arising from inaccurate information, incomplete documentation, or prohibited items.

Article 4: Prohibited and Restricted Items

  1. The Sender is prohibited from shipping items including but not limited to narcotics, illegal drugs, weapons, explosives, hazardous materials, live or dead animals, obscene materials, cash, precious metals, uninsured valuables, and other illegal goods.
  2. The Service Provider reserves the right to inspect Shipments suspected of containing prohibited or restricted items without prior notice.
  3. The Sender bears full legal and financial responsibility for shipping prohibited or restricted items.

Article 5: Pricing and Payment

  1. Shipping fees are calculated based on actual or volumetric weight (whichever is higher), destination, and selected service type.
  2. All rates and charges are subject to change with prior notice.
  3. Payment must be made in advance unless otherwise agreed in writing.
  4. Late payments may result in shipment delays or additional charges.

Article 6: Customs Process

  1. The Sender authorizes the Service Provider or its agents to act as the Sender’s representative for customs procedures.
  2. The Sender is fully responsible for the accuracy and completeness of customs documentation. Any fines or penalties arising shall be borne by the Sender.
  3. The Service Provider is not responsible for delays or detention by customs authorities.

Article 7: Tracking and Delivery

  1. The Sender may track the Shipment using the Tracking Number through the Service Provider’s tracking system.
  2. Delivery will be made to the Recipient’s stated address. If unavailable, delivery attempts may follow internal policies.
  3. Proof of delivery may be in physical or electronic form and shall have equal legal validity.
  4. Special delivery proof requests must be agreed upon in advance and may incur additional charges.

Article 8: Limitation of Liability and Insurance

  1. The Service Provider’s maximum liability for loss or damage (without insurance) is limited to the lowest of: declared value, ten (10) times the shipping fee, or IDR 1,000,000.
  2. Liability is limited to direct loss and excludes indirect or consequential damages.
  3. If additional insurance is purchased, compensation follows the insurance policy terms.
  4. The Sender must provide accurate shipment information for insurance purposes.

Article 9: Complaints and Claims

  1. Service complaints must be submitted in writing within fourteen (14) days of delivery.
  2. Claims for loss or damage must be submitted within fourteen (14) days of the expected or actual delivery date.
  3. Claims must be supported by complete documentation.
  4. Claim values are limited to the declared shipment value.
  5. The Service Provider will process valid claims within thirty (30) business days.

Article 10: Governing Law and Dispute Resolution

  1. This TNC is governed by the laws of the Republic of Indonesia.
  2. Disputes shall first be resolved through amicable discussion.
  3. If unresolved within thirty (30) days, disputes shall be submitted to the jurisdiction of the Central Jakarta District Court.

Article 11: General Provisions

  1. The Service Provider may amend these Terms at any time with prior notice.
  2. If any provision is deemed invalid, the remaining provisions shall remain in full force.
  3. This TNC constitutes the entire agreement between the Sender and the Service Provider.
  4. The Sender consents to the use of personal data for service and legal purposes.
  5. The Sender confirms having read, understood, and agreed to these Terms and Conditions.
