TERMS AND CONDITIONS OF DELIVERY SERVICES
(Terms & Conditions / TNC)
These Terms and Conditions of Delivery Services ("TNC") govern the contractual relationship between Rayspeed Asia ("Service Provider") and the Shipper in relation to the delivery of goods and documents. By using the Service Provider’s services, the Shipper is deemed to have read, understood, and agreed to all provisions of this TNC.
ARTICLE 1: DEFINITIONS
- Service Provider: Refers to Rayspeed Asia, which provides delivery services for goods and documents.
- Shipper: The party that hands over goods or documents to the Service Provider for delivery.
- Consignee: The party designated to receive the delivered goods or documents.
- Shipment/Consignment: Goods or documents handed over to the Service Provider for delivery.
- Tracking Number: A unique number issued by the Service Provider for each Shipment, serving as identification and tracking reference.
- Customs: Government authority responsible for supervision and collection of duties/taxes on goods entering or leaving a country.
- Force Majeure: Extraordinary circumstances beyond reasonable control of the parties, including but not limited to natural disasters, war, riots, government actions, transportation regulations, or other unforeseen disruptions.
ARTICLE 2: SCOPE OF SERVICES
- The Service Provider provides delivery services for goods and documents from the Shipper’s location to the designated serviceable destination.
- Services include pickup, customs clearance, transportation, and delivery.
- The Service Provider reserves the right to refuse Shipments that are unlawful, dangerous, unsafe, or non-compliant with regulations of the origin and destination countries or carrier policies.
- The Service Provider reserves the right to open and inspect Shipments without prior notice for security, legal, or regulatory purposes.
- If a Shipment is rejected, cannot be accepted, or cannot be returned due to regulations of the origin country, destination country, or transportation carrier, it may be destroyed without liability.
ARTICLE 3: SHIPPER OBLIGATIONS

The Shipper agrees and is responsible for providing complete and accurate information regarding the Shipment, including but not limited to:
- Full name, address, identification number, and contact details of the Shipper and Consignee.
- Detailed description of the Shipment contents.
- Declared value of the Shipment.
- Supporting documents required in the origin and destination countries, as well as by the carrier.
- Packaging of the Shipment is entirely the responsibility of the Shipper.
- The Shipper must ensure proper, secure, and appropriate packaging according to the nature of the goods and delivery standards to prevent damage during transit.
- If the Shipper uses paid packaging services provided by the Service Provider, responsibility for packaging quality shifts to the Service Provider in accordance with its packaging standards; however, responsibility for contents and provided information remains with the Shipper.
- The Shipper guarantees that the Shipment contents do not violate laws, regulations, or prohibitions in the origin, transit, or destination countries, or carrier policies, including but not limited to hazardous, illegal, or prohibited goods.
- The Shipper is responsible for all delivery costs, import duties, and taxes in the destination country if the Consignee refuses payment, including handling and any other related charges, unless otherwise agreed.
- The Shipper represents and warrants that they are the lawful owner or have full authority to hand over the Shipment and that it is free from liens or third-party claims.
- The Shipper releases the Service Provider from any legal claims arising from inaccurate information, incomplete documentation, or prohibited goods.
ARTICLE 4: PROHIBITED AND RESTRICTED GOODS

The Shipper is prohibited from sending the following goods (including but not limited to):
- Narcotics, illegal drugs, and other addictive substances.
- Firearms, ammunition, explosives, and their components.
- Hazardous materials (flammable, corrosive, radioactive, toxic, etc.).
- Live or dead animals.
- Printed materials, recordings, or media that violate morality or the law.
- Cash, checks, precious metals, jewelry, or other high-value items without adequate insurance.
- Other illegal goods under the laws of the origin, transit, and destination countries.
- The Service Provider reserves the right to open and inspect Shipments suspected of containing prohibited or restricted goods without prior notice.
- The Shipper bears full legal and financial responsibility for consequences arising from shipping prohibited or restricted goods.
ARTICLE 5: PRICING AND PAYMENT
- Delivery charges are based on actual or volumetric weight (whichever is greater), destination, and selected service type.
- All rates and charges are subject to change with prior notice.
- Payment must be made in advance unless otherwise agreed in writing and signed by the Shipper and Service Provider.
- Late payment may result in delivery delays or additional charges.
ARTICLE 6: CUSTOMS PROCESS
- The Shipper authorizes the Service Provider or its agents to act as the Shipper’s representative in carrying out necessary customs procedures.
- The Shipper is fully responsible for the accuracy and completeness of customs documentation. Any fines, penalties, or charges arising from inaccuracies or incompleteness shall be borne by the Shipper.
- The Service Provider is not responsible for delays or detention of Shipments by customs due to inspections, incomplete documentation, or regulatory violations.
ARTICLE 7: TRACKING AND DELIVERY
- The Shipper may track Shipment status using the Tracking Number via the Service Provider’s website or tracking system.
- Delivery will be made to the Consignee’s stated address. If the Consignee is unavailable, the Service Provider may leave a notice or attempt redelivery in accordance with its policy.
- Proof of delivery may be in the form of a signed physical document or electronic tracking data (such as “Delivered” status with recipient information). Both are deemed valid and legally binding.
- Special requests for proof such as photos, specific signatures, or other forms must be submitted in writing and agreed upon in advance and may incur additional charges.
ARTICLE 8: LIMITATION OF LIABILITY AND INSURANCE

Maximum liability of the Service Provider for loss or damage to uninsured Shipments is limited to the lowest of:
- The declared value stated on the shipment receipt; or
- Ten (10) times the delivery charge; or
- IDR 1,000,000 (One Million Rupiah).
Whichever is the lowest, in accordance with Law No. 38 of 2009 concerning Postal Services.
- This limitation applies only to direct compensation for the value of goods and excludes indirect, incidental, or consequential losses.
- If the Shipper purchases additional insurance, compensation shall be subject to the insurance policy terms.
- The Shipper must provide shipment information in accordance with Article 3.1 for insurance purposes.

The Service Provider is not responsible for:
- Damage to data or electronic media.
- Loss or damage caused by Force Majeure.
- Loss or damage caused by acts or negligence of the Shipper, Consignee, or third parties.
- Loss or damage to prohibited or restricted goods.
- Delivery delays caused by customs, government authorities, or factors beyond the Service Provider’s reasonable control.
- The Shipper understands and agrees that the Service Provider’s liability is limited as set forth herein.
- The Shipper releases the Service Provider from any claims arising from personal interpretation or matters not expressly regulated in this TNC or standard industry practices.
ARTICLE 9: COMPLAINTS AND CLAIMS
- Complaints regarding services (other than loss or damage) must be submitted in writing within 14 days after delivery.
- Claims for loss or damage must be submitted in writing within 14 days from the expected delivery date (for loss) or the date the damaged Shipment is received.

Claims must be accompanied by complete supporting documents, including but not limited to:
- Copy of the Tracking Number.
- Details of the loss or damage.
- The claimed value shall be based on the declared value stated on the shipment receipt.
- For damage claims, the Shipper must provide an unboxing video showing the package condition before opening and during the unboxing process until the damage is clearly visible.
- Damage claims without sufficient unboxing video evidence may be rejected.
- Claims will be processed within 30 business days after complete and valid documents are received.
- Claims apply only to loss or damage and do not apply to delivery delays.
- Claims for indirect losses such as loss of sales, project penalties, production costs, replacement costs, interest costs, or other business losses will not be compensated.
- Claims submitted beyond the specified time limit or without complete documentation will be rejected.
- The Service Provider is not responsible for claims arising from prohibited goods, inadequate packaging, or inaccurate information.
- Each Shipment is limited to one final claim, which constitutes full and final settlement for all related loss or damage.
ARTICLE 10: GOVERNING LAW AND DISPUTE RESOLUTION
- This TNC is governed by and interpreted in accordance with the laws of the Republic of Indonesia.
- Any dispute arising from or in connection with this TNC shall first be resolved through deliberation and consensus.
- If no resolution is reached within 30 days, the dispute shall be submitted to the jurisdiction of the Central Jakarta District Court.
ARTICLE 11: GENERAL PROVISIONS
- The Service Provider reserves the right to amend this TNC at any time with notice to the Shipper.
- If any provision of this TNC is declared invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
- This TNC constitutes the entire agreement between the Shipper and the Service Provider regarding the services provided.
- The Shipper grants permission for the Service Provider to use personal data and shipment information for service delivery, legal documentation, and operational improvement purposes.
- The Service Provider is committed to maintaining data confidentiality in accordance with applicable laws but is not responsible for data breaches caused by third parties or events beyond reasonable control.
- The Shipper has read, understood, and agreed to all Terms and Conditions herein.
